Terms of supply/installation and repairs:
These are the Terms and Conditions of Quotation, Service Delivery and Sale of all products supplied, repaired and/or installed by Fried Electrical except as otherwise expressly agreed upon in writing between a duly authorised officer of Fried Electrical and the customer. These Terms and Conditions will apply despite any provisions that may appear opposing on any document or agreement between the Customer and Fried Electrical.
(a) Customer means any person requesting a service offered by Fried Electrical for supply/installation and repair at any property or premises.
(b) Fried Electrical is the company with which the customer is dealing with and whose name and ABN is supplied on quotes, invoices or other written documents provided to the customer
(c) Quote refers to any document containing a price (estimated or otherwise) generated via an electronic device or in written form.
(d) Job means any service including but not limited to supply, installation, repair and maintenance rendered as per the customer request.
2. Binding Nature:
(a) All job orders placed at [Fried Electrical by the customer shall move forward assuming that the customer as accepted these terms and conditions and is bound to request service, sign quotes and pay partial payments or complete invoices based on the terms and conditions laid out herein.
(b) Fried Electrical reserves the right to alter any or all clauses of these terms and conditions anytime, with or without prior notice to its customers.
(a) Quotes may be exact price charged to the customers or they could be estimates which may be changed after site visit. Fried Electrical reserves the right to change the quote on its sole discretion in case or any error, even if the earlier quote has been accepted by the customer.
(b) The quoted sum will be valid for no more 30 days. Customers contacting Fried Electrical for the same service requested earlier, will be required to request a new quote, which may or may not be the same as the prior quote.
(c) The sum of the quote is subject to change by Fried Electrical if the customer requests a variation from the original service request.
(d) Any deposit made by the customer after accepting the quote may or may not be refundable based on Fried Electrical sole discretion. The amount the Fried Electrical decides to withhold will include the cost incurred in carrying out the work completed thus far.
4. Terms of payment:
(a) Customer can make payment via cash, bank transfer or a granted credit account based on the accepted final quote.
(b) All payments must be made within 7 working days of job completion.
(c) In case the customer fails to make the payment within 7 days of job completion, a surcharge of 10% shall be charged in addition to the actual amount to be paid.
(d) The customer is not entitled to deduct any amount from the signed quote or agreed upon payment, or withhold any part of the payment in case of a dispute over job completion or work order.
(e) Fried Electrical holds the right to cease any work-in-progress in case the customer withholds any previously due payments as a result of a dispute.
5. Completion time:
(a) The start date and time provided in the quote will only be an estimate, rather than the exact time of arrival at site.
(b) Any deviation from the time, shall not result in cancelation of the accepted quote by the customer not the customer can hold Fried Electrical liable for any loss or damage as a result of the deviation in the estimated time of delivery or completion of job.
(a) Customers are required to inspect the repair/maintenance or installation as soon as the job has been completed. Fried Electrical will not be held responsible of any damages, defects or issues raised after 7 days of service delivery.
(b) Fried Electrical will be allowed to take photos of the required job before starting and after completion, for its own record keeping and audit process.
(c) Fried Electrical will not be held liable for any work done by the customer themselves on the already completed job delivered by Fried Electrical.
7. Use of products:
(a) Fried Electrical may provide a written agreement of the products that will be used while rendering a requested service. However, in case of availability of the mentioned products, Fried Electrical holds the right to subsite the product with a reasonable alternative, without termination of the work order by the customer.
8. Privacy and use of information:
(a) The customer acknowledges that Fried Electrical can collect, store and use their personal information such as name, contact details and address for the purpose of record keeping and doing business in the future.
(b) Fried Electrical agrees not to exchange customers’ personal information with any third parties without their prior consent.
(c) Fried Electrical holds the right to disclose any information of the customer in case of failure of payment and share it with a collection agency.
INVOICING TERMS AND CONDITIONS
1. Terms of payment:
(a) Customer can make payment via cash or bank transfer or any other electronic payment method approved by Fried Electrical
(b) Customer can make a credit payment, only if agreed upon by Fried Electrical. A credit account will be granted to the customer based on the accepted final quote.
(c) All payments must be made within 7 working days of job completion.
2. Late payment/Non-Payment
(a) In case the customer fails to make the payment within 7 days of job completion, a surcharge of 10% shall be charged in addition to the actual amount to be paid. This can be considered as late fees, to cover the losses incurred to Fried Electrical
(b) Fried Electrical holds the right to cease any work-in-progress in case the customer withholds any previously due payments as a result of a dispute.
3. Tax and Duties
(a) All invoices will be subject to GST unless specified otherwise.
(b) The Customer is liable to pay GST and no invoice payment will be acceptable if it doesn’t include GST.
(c) In case of any reimbursement the customer is eligible to, would exclude any amount that represents GST.
4. Changes to Quote
(a) The customer is not entitled to deduct any amount from the signed quote or agreed upon payment, or withhold any part of the payment in case of a dispute over job completion or work order.
(b) In case of any variation requested by the Customer, Fried Electrical hold complete right to provide customer with a new quote incorporating the cost of the variation requested and any subsequent invoice will be based on the later quote.
5. Debt Collection Policy
(a) Fried Electrical holds the right to share Customer’s details with a debt collection agency, in case the Customer fails to make payment based on the Terms of Payment, mentioned above.
